Qurʾān · an-Nisāʾ 4:11 Sons · daughters · parents
Allah instructs you concerning your children: the male receives a share equal to that of two females — the basis of the 2:1 residuary split and the children's shares.
Explications des savants
Ibn Kathīr · Tafsīr Ibn Kathīr · an-Nisāʾ 4:11
Ibn Kathīr explains the wisdom of the male's double share: because the man bears the burden of maintenance (nafaqa), expenses, and the hardship of trade and earning, it is fitting he receive double what the female takes.
al-Saʿdī · Tafsīr al-Saʿdī · an-Nisāʾ 4:11
al-Saʿdī: among children the male takes the share of two females; a single daughter takes one-half and two or more take two-thirds (by consensus), while each parent takes one-sixth when there is a child, the mother never exceeding a sixth alongside children.
IslamQA · IslamQA · fatwā no. 288330
IslamQA: the "male = two females" rule applies when male and female heirs inherit together — not as a blanket ratio — and its wisdom lies in the man's duty of maintenance and dowry; in other cases women inherit equal to or more than men.
﴿وَلَكُمْ نِصْفُ مَا تَرَكَ أَزْوَاجُكُمْ إِن لَّمْ يَكُن لَّهُنَّ وَلَدٌ﴾
Qurʾān · an-Nisāʾ 4:12 Husband · wife · maternal half-siblings
For you (husbands) is one-half of what your wives leave if they have no child — and the rules for wives' shares and uterine (maternal) siblings.
Explications des savants
Ibn Kathīr · Tafsīr Ibn Kathīr · an-Nisāʾ 4:12
Ibn Kathīr: the kalāla is one inherited by collateral relatives — neither ascendants nor descendants (Abū Bakr: "one with no child and no parent"); and ʿUmar ruled the maternal siblings divide their share equally, male like female.
al-Saʿdī · Tafsīr al-Saʿdī · an-Nisāʾ 4:12
al-Saʿdī: the maternal (uterine) siblings each take one-sixth if a single one, and if more than one they jointly share one-third, their male and female inheriting equally.
IslamWeb · IslamWeb · fatwā no. 108361
IslamWeb: scholars agree the "brother or sister" in 4:12 are specifically the maternal siblings — a single one gets a sixth, and more than one share a third equally between male and female.
﴿يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلَالَةِ﴾
Qurʾān · an-Nisāʾ 4:176 Full & paternal siblings
They seek your ruling. Say: Allah gives you a ruling concerning the kalāla (one with no parent or child) — the basis for the shares of full and paternal siblings.
Explications des savants
al-Saʿdī · Tafsīr al-Saʿdī · an-Nisāʾ 4:176
al-Saʿdī: the "sister" here is the full or paternal sister (not maternal); one sister takes a half, two or more take two-thirds, and when full/paternal brothers and sisters inherit together the male takes the share of two females — the sisters becoming residuary through their brothers.
Ibn Kathīr · Tafsīr Ibn Kathīr · an-Nisāʾ 4:176
Ibn Kathīr reports ʿUmar saying he asked the Prophet ﷺ about the kalāla more than anything, until the Prophet pressed his chest and said "the Verse of Summer at the end of Sūrat an-Nisāʾ suffices you"; and al-Barāʾ said this was the last verse revealed.
IslamWeb · IslamWeb · fatwā no. 50513
IslamWeb distinguishes the two: the siblings in 4:12 are the maternal siblings (who inherit equally), while those in the kalāla verse 4:176 are the full or paternal siblings, under the "male = two females" rule.
«أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا، فَمَا بَقِيَ فَهُوَ لِأَوْلَى رَجُلٍ ذَكَرٍ»
Ḥadīth · al-Bukhārī 6732 · Muslim 1615 (muttafaq ʿalayh, Ibn ʿAbbās) Residuary (ʿaṣaba)
Give the fixed shares to those entitled to them; whatever remains goes to the nearest male heir — the rule of ʿaṣaba (the residuary).
Explications des savants
al-Nawawī · Sharḥ Ṣaḥīḥ Muslim · al-Nawawī · Kitāb al-Farāʾiḍ
al-Nawawī: the scholars say "the nearest male" (awlā rajul) means the closest male in kinship — from al-waly (proximity) — not "the most entitled"; whatever the fixed shares leave goes to that closest male.
Ibn Ḥajar al-ʿAsqalānī · Fatḥ al-Bārī · Ibn Ḥajar · Kitāb al-Farāʾiḍ
Ibn Ḥajar: what remains after the fixed shares belongs to the ʿaṣaba (the agnatic residuary heirs), the nearer relative given precedence over the more distant.
IslamWeb · IslamWeb · article no. 222289
IslamWeb: the fixed Qurʾānic shares are first given to their holders, and whatever then remains passes to the male residuary heirs (ʿaṣaba), precedence going to the one nearest in kinship to the deceased — not the neediest.
